Welcome to TALONSBPHOTOGRAPHY (the "Site"), operated by Bolme Creative ("we," "us," or "our"). By accessing or using this Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use this Site.

1. Product Description & Usage Rights
Physical Prints Only: All products sold are physical, unframed prints only. We do not sell digital downloads, licenses, or raw image files on this site. If you are interested in digital license sales, please contact us at talon.bolme@gmail.com.

2. Terms of Sale

2.1. Licenses
Personal Use License: Purchasing a print grants you a non-exclusive, non-transferable license to display the print in your home or private space for personal enjoyment only.
Prohibited Uses: You may not :Use the images for commercial purposes (e.g., advertising, websites, merchandise, or publications).
Resell, redistribute, or transfer the print to a third party for profit.
Reproduce the image in any form (digital or physical) beyond the single print purchased.
Alter, crop, filter, or modify the image in any way.
Portfolio Rights: We retain the full copyright to all images. We reserve the right to use any image sold (including the specific print you purchased) in our portfolio, marketing materials, social media, and press releases without further compensation or notice to you.

2.2. Orders, Pricing, & Taxes
Pricing: Prices are listed in USD. We reserve the right to change prices at any time without notice.
Taxes: Sales tax and VAT are calculated and collected automatically at checkout based on your shipping address and applicable laws.
Availability: We strive to keep all items in stock, but we reserve the right to discontinue any print or size at any time. If an item becomes unavailable after you place an order, we will notify you and issue a full refund for that item.

2.3. Production & Shipping
Production Time: Orders are processed within 2–4 business days after payment confirmation. This timeframe excludes weekends and holidays.
Shipping: We ship worldwide via our third-party printing labs.
Shipping costs and estimated delivery times are calculated at checkout based on the destination and the specific lab selected for your order.
Custom Sizing: We currently offer standard sizes up to 16x24 inches. Custom sizing is not available at this time.
Paper Quality: Prints are produced on various archival paper stocks (e.g., Matte, Glossy, Luster) as selected by you at checkout. The specific finish is determined by the options available for the selected size.

2.4. Color Accuracy & Framing
Color Variance: Due to differences in monitor calibration and printing technologies, colors on your screen may vary slightly from the final printed product. We strive for the highest color accuracy possible, but we cannot guarantee an exact match to your digital display.
Framing Disclaimer: All prints are sold unframed. We are not responsible for any damage to the print caused by improper framing, mounting, or handling after the package leaves our fulfillment center. We recommend consulting a professional framer for the best results.

2.5 Returns, Refunds, & Damaged Goods
No Returns on Custom Items: Because all prints are custom-made to order, we do not accept returns or exchanges for change of mind, incorrect size selection, or color preference.
Damaged or Lost Packages: In the unlikely event that your print arrives damaged (torn, creased, water-damaged) or is lost in transit, you must contact the fulfillment lab directly to initiate a claim.
Please contact us at talon.bolme@gmail.com within 48 hours of delivery with photos of the damage. We will assist you in coordinating with the lab for a replacement or refund, but the resolution is subject to the lab's investigation and policy.
Digital Files: As we do not sell digital files, no refunds apply to digital downloads.

2.6. Limitation of Liability
To the fullest extent permitted by law, talonsbphotography shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your purchase of our prints. Our total liability for any claim shall not exceed the purchase price of the specific print in question.

2.7. Governing Law
These Terms of Sale shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in South Carolina.

2.8 Changes to These Terms
We reserve the right to update or modify these Terms of Sale at any time without prior notice. Your continued use of the site and purchase of prints after any changes constitutes your acceptance of the new terms.

3. Intellectual Property Rights

3.1 Ownership. All content displayed on this Site, including but not limited to photographs, images, graphics, logos, text, and the overall design ("Content"), is the exclusive property of Bolme Creative and is protected by United States and international copyright laws.

3.2 No Transfer of Rights. Purchasing a print or digital file from this Site grants you a limited, non-exclusive, non-transferable license to display the purchased item for personal, non-commercial use only. It does not transfer copyright ownership. You do not own the photograph itself.

3.3 Prohibited Uses. Unless explicitly granted written permission by us, you may not:

• Reproduce, distribute, modify, or create derivative works of any Content.

• Use any Content for commercial purposes (including advertising, marketing, or resale).

• Remove, obscure, or alter any copyright notices, trademarks, or other proprietary notices.

• Use any Content in a way that implies endorsement by us of your products or services.

4. Prohibition on Scraping, Botting, and Bootlegging

4.1 Automated Access. You agree not to use any automated means (including bots, scrapers, spiders, crawlers, or data mining tools) to access, extract, or download any Content from this Site.

4.2 Image Theft. Any attempt to bypass security measures, disable right-click functions, or use third-party software to download high-resolution versions of our images without purchasing them is strictly prohibited and constitutes copyright infringement.

4.3 Resale of Digital Files. You are strictly prohibited from reselling, sharing, or distributing any digital files obtained from this Site. This includes, but is not limited to, uploading our images to stock photo sites, selling them as prints on other platforms (e.g., Etsy, Redbubble), or distributing them on social media for commercial gain.

5. Digital Rights Management (DRM)

5.1 Watermarked Previews. All images displayed on this Site for browsing purposes only. Copying, editing, or redistributing these images is a violation of these Terms and applicable copyright law.

6. DMCA and Copyright Infringement

We take intellectual property rights seriously. If you believe your work has been infringed upon, or if you discover unauthorized use of our images on the internet, please contact us immediately.
